Purpose and Application

This privacy policy (the “Privacy Policy”) applies to Shaw Mobile (“Shaw Mobile”, “us” or “we”). Shaw Mobile is very sensitive to the privacy concerns of our customers, potential customers and visitors to our website, so we have developed this Privacy Policy to:

describe what types of Personal Information (as described below) we collect from customers, potential customers and visitors to our website and stores;
set out the purposes for which we use Personal Information;
identify the third parties to whom we disclose Personal Information;
describe how we safeguard Personal Information;
set out what rights you have regarding Personal Information; and let you know how to contact us if you have questions or concerns

Shaw Mobile is committed to protecting Personal Information and has established its Privacy Policy using the ten principles set out in the national standard of Canada entitled Model Code for the Protection of Personal Information. These ten principles are the following:

Shaw Mobile Compliance

Shaw Mobile relies on these ten principles to protect the Personal Information collected from its customers, potential customers and visitors to our website. Shaw Mobile has established this Privacy Policy in accordance with The Personal Information Protection and Electronic Documents Act (“PIPEDA”)

This Privacy Policy does not apply to independent retailers of our products and services, except to the extent they provide us with your Personal Information to enable us to deliver services to you. Personal Information and Collection

In this Privacy Policy, “Personal Information” means information about an identifiable individual, for example an individual’s name, account number, e-mail address, payment information, user logs or certain numbers associated with that individual’s equipment (for example a wireless phone number) if Shaw Mobile can link such numbers to the individual. It does not include aggregate information that cannot be associated with a specific individual. We only collect Personal Information when you voluntarily submit it to us, when you authorize us to collect it from third parties or when third parties have the right to provide us your Personal Information. Use of Information

Shaw Mobile and its affiliates may use Personal Information for the following purposes:

to conduct marketing research;
to send you marketing and other communications;
to understand your needs and preferences and your eligibility for our products & services;
to develop and enhance our products and services;
to provide you products and services, including sending and receiving confirmations, communications and bills, validating your identity, providing you support;
to respond to specific requests from you;
to administer and manage our business and operations, including the protection of the security and integrity of our services and our website; and
to meet legal and regulatory requirements.

We will only use your Personal Information for the purposes for which it was collected, and will only retain your Personal Information only as long as we require it for such purposes. Our general retention guideline is a 7-year period, which extends to all our corporate records including our customer & billing database. This allows us to meet our financial accountability and SOX audit obligations. Outside of the 7-year period, retention is defined based on length of time information is needed to meet the purpose(s) for which it has been collected and takes into account the sensitivity of the personal information. For example, we keep call records for 2 years, and IP logs for 180 days.

Shaw Mobile Wi-Fi

Shaw Mobile will automatically collect certain information such as Device location, Device type, and general usage information associated to the Media Access Control (“MAC”) address associated with your Device (the “Device Information”). The Device Information is used to deliver the Shaw Mobile Wi-Fi service, monitor and improve network traffic, improve your Shaw Mobile Wi-Fi experience and for research and statistical purposes. In certain instances, Shaw Mobile will rely on a third party to deliver Shaw Mobile Wi-Fi services at a specified location (for example, certain airports, universities or other public buildings). The relationship with the third party is governed by strict privacy provisions, in compliance with PIPEDA. As part of the delivery of the Shaw Mobile Wi-Fi services, the third party may have access to the Device Information, which can only be used for limited network monitoring and improvement purposes.

Disclosure of Information

Shaw Mobile may share Personal Information it collects to independent contractors of Shaw Mobile, subsidiaries and affiliates of Shaw Mobile, consultants, business associates, authorized retailers, dealers, suppliers, service providers, roaming partners, directory listing providers and credit and collection agencies, if and to the extent the disclosure will enable that party to perform a function related to one of the purposes described above.

In the event that a third party service provider or roaming partner is located in a foreign country, Personal Information may be processed and stored in such other foreign country. In such circumstances, the governments, courts or law enforcement or regulatory agencies of that country may be able to obtain access to your Personal Information through the laws of the foreign country. When Shaw Mobile engages a third party service provider, we require that its privacy and security standards adhere to this Privacy Policy and applicable Canadian privacy legislation.

Except as required or permitted by law, when disclosure is made to a third party other than a Shaw Mobile associate or affiliate, a third party service provider or roaming partner, the consent of the individual shall be obtained and reasonable steps shall be taken to ensure that any such third party has Personal Information privacy procedures and policies in place that are comparable to those implemented by Shaw Mobile. Such third parties are provided only with such information as is necessary in the circumstances. Personal Information provided to third parties may be used only for the purpose stipulated and is subject to strict terms of confidentiality.

We may from time to time engage in transactions such as the sale or securitization of assets, the sale of shares in our company, amalgamations and similar transactions and will disclose Personal Information to other persons in connection with their review of such a transaction.

We will also disclose Personal Information as required to meet legal and regulatory requirements or to support emergency calls (for example 911 calls).

Safeguarding Personal Information

We maintain physical, electronic, and procedural safeguards designed to protect your Personal Information. We review such safeguards on a periodic basis and revise them if necessary. We take reasonable steps designed to limit access to Personal Information only to persons as provided for in this Privacy Policy.

Shaw Mobile primarily routes voice traffic on its wireless network internally and through domestic alternate carriers for back-up purposes. Voice traffic is routed outside of Canada when calls are made by Shaw Mobile customers to a non-Canadian destination or when a Shaw Mobile customer calls outside of Canada using their Device.

Your Rights

You may:

refuse to provide us with your Personal Information;
ask us for access to Personal Information that we hold about you;
ask us for information about our policies and procedures relative to the management of Personal Information
ask us to correct any inaccuracies or omissions in your Personal Information; or
ask us to remove Personal Information we possess, subject to reasonable notice, existing legal or regulatory obligations and our reasonable business requirements

However, we may not be able to offer you some of our services or functions of our website if you do not provide us with certain Personal Information or ask for your Personal Information to be removed. Marketing communications will only be sent to you if you elect to receive them when you register on our website or when you sign up for our services. You may opt out of receiving marketing communications at any time by selecting the “unsubscribe” option (in the case of e-mail communications), visiting our website or contacting our call centre.

Transparency Report

Shaw Mobile complies with Canadian privacy law and take active steps to fully safeguard the information of our customers. At the same time we are compelled by law to respond to federal, provincial and municipal government and law enforcement agencies when they have a legally valid request ‐ like a search warrant or court order. Our customers' privacy is important to us and that is why we have issued a Transparency Report. You may purchase By The Gig Data one-time passes $10 per 1GB, valid for up to 90 days, which can be used on the Shaw or Nationwide Networks. 5. Auto Payment

This plan requires Auto Payment otherwise an additional $5/month charge will be applied for each month the pre-authorized payment (Auto Payment) is not activated on your account. All Shaw Mobile services are subject to our Terms of Service, Internet Traffic Management Policy, Fair Usage Policy and Privacy Policy.

6. Unlimited Plans Data Policy

Shaw Mobile’s Unlimited data plans include 25GB of Fast LTE data on the Shaw Network, as well as 2GB data on the Shaw Nationwide Network, or Shaw Nationwide + U.S. & Mexico if subscribed to Unlimited + U.S. & Mexico. Once your allotment is depleted, you will continue to have access to data services, with no data overage fees, but at a slower speed – of up to 256 kilobits per second (for downloads) and 128 kilobits per second (for uploads) on the Shaw Network, and up to 128 kilobits per second (for downloads) and 64 kilobits per second (for uploads) on the Nationwide Network. While roaming in the U.S. or Mexico on the Unlimited + U.S. & Mexico your data access will be halted after 2GB unless additional One-Time Passes are purchased. Additional details can be found in the Fair Usage Policy.

We will send you a text message notifying you when you have used 70% and 100% of the allotment included in your plan, at which point you may choose to purchase more data to your plan. In all cases, usage is subject to the Shaw Mobile Terms of Service and Fair Usage Policy.

7. Unlimited Talk & Text

All plans include unlimited incoming talk & outgoing Canada-wide talk from the Shaw or Nationwide Networks to Canadian phone numbers. All plans also include unlimited global text, picture, and video messaging when connected to the Shaw or Nationwide Networks.

Unlimited + U.S. & Mexico includes unlimited incoming talk & text and unlimited outgoing talk & text to Canadian, U.S. & Mexico numbers while in Canada (on the Shaw or Nationwide Networks) and, while in the U.S., to the U.S. and back to Canada, or, in Mexico, to Mexico or back to Canada. Additional pay-per-use and long distance charges may apply. For example, while roaming in the U.S., calls and text messages to Mexico will incur additional long-distance and pay-per-use charges, respectively.

8. Pay Per Use, One-Time Passes and Add-On Charges

Pay Per Use, One-Time Passes and Add-On charges are extra and subject to change.

9. Shaw Go WiFi

Shaw Mobile customers get exclusive access to over 450,000 WiFi hotspots across Western Canada.

10. Discount

Based on an eligible Internet and mobile bundle plan from Shaw compared to a mobile-only plan. Speeds reduced beyond 25GB fast LTE data. Auto payment and approved credit required. Conditions apply.

11. Connection fee

A non-refundable one-time connection fee of $45 applies to each new line activation or hardware upgrade.

12. Eligibility

Eligible customers must be subscribed to an eligible Shaw Internet plan and reside within the Shaw wireless coverage area. For more coverage information see shawmobile.ca/coverage. 15. Determining the value of your Trade-In Device

Must be legal owner of the phone traded in. Maximum 1 phone per trade-in. Your device Trade-In value is determined by us in our sole discretion and is based on phone make, model, and physical condition. You will not receive extra value for trading in other in-box accessories (Example: charger, earbuds, external case, etc.). If we determine, in our sole discretion, that your Trade-In Device has no Trade-In value we will gladly take it and recycle it for you. As part of our ongoing green initiatives, any mobile phone may be dropped off at any Shaw Mobile store for responsible recycling. The 888 long-distance minutes can be used on the Shaw and Nationwide networks. Any unused portion of your monthly 888 international long-distance minutes will not carry forward to the next month. To be eligible for 8 months free on the $5 add-on, you must activate a new line on Unlimited plans with 25GB Fast LTE. An international long-distance add-on will be added to your account at $5/month. You will receive a $5 discount of the monthly price of the add-on for 8 months as long as you remain active, in good standing, subscribed to an Eligible Plan and subscribed to the $5/month add-on. 20. A non-refundable one-time connection fee of $45 applies to each new line activation or hardware upgrade.

21. Offer available for a limited time for new line activations on all Unlimited + U.S. & Mexico plans. $5/mo discount is ongoing unless forfeited as a result of a rate plan change or line cancellation. Compatible with bring-your-own-phone and MyTab activations. Offer subject to change or cancellation without notice.

22. Samsung Double Storage Offer

Offer is available for a limited time to eligible new and existing customers at participating Shaw Mobile retail locations. Available only while supplies last and subject to change or cancellation without notice. Early cancellation fees apply.

Samsung Galaxy S23 (256GB) Offer

To be eligible for the $4/month credit for 24 months offer, you must pre-order and subsequently activate a new service or upgrade your phone to the Samsung Galaxy S23 256GB storage size on an Unlimited plan on a 24 month services agreement. You’ll receive $96 in service credits applied as a $4 monthly credit on your account for up to 24 months, to a maximum of $96.

Samsung Galaxy S23+ (512GB) Offer

To be eligible for the $8/month credit for 24 months offer, you must pre-order and subsequently activate a new service or upgrade your phone to the Samsung Galaxy S23+ storage size on an Unlimited plan on a 24 month services agreement. You’ll receive $192 in service credits applied as an $8 monthly credit on your account for up to 24 months, to a maximum of $192.

Samsung Galaxy S23 Ultra (512GB) Offer

To be eligible for the $12/month credit for 24 months offer, you must pre-order and subsequently activate a new service or upgrade your phone to the Samsung Galaxy S23 Ultra 512GB storage size on an Unlimited plan on a 24 month services agreement. You’ll receive $288 in service credits applied as a $12 monthly credit on your account for up to 24 months, to a maximum of $288.

The credits will start to be applied to your account as a bill adjustment before tax on your 1st bill. The credits will be applied as long as your account is in good standing (not suspended or cancelled) and as long as you continue to be eligible. You will no longer be eligible for the promotion if you: a) Downgrade your rate plan to a non-eligible plan; b) Port your number away from Shaw Mobile; or c) Cancel your Shaw Mobile account. If you are not eligible for the promotion during any month, that credit will be entirely forfeited and cannot be made up. If you qualify for the credit in the months following the ineligible month, you will continue to receive the credit as applicable.

23. Samsung S23, S23+, S23 Ultra Trade In offer

A one-time $45 connection fee will apply for each new activation or hardware upgrades.    

Offer available only in select stores to eligible customers on approved credit and while supplies last. This offer is subject to change or cancellation without notice. Trade in offer is valid only on purchase of a Samsung Galaxy S23, Samsung Galaxy S23+ or Samsung Galaxy S23 Ultra . Mobile phones purchased must be activated on the Shaw Mobile network on a 24-month services agreement and on unlimited plans. Must be a legal owner of the phone traded in. Maximum 1 phone per trade-in.
